उपभोक्ता संरक्षण अधिनियम में नहीं आता है व्हाट्सएप: उपभोक्ता फोरम

लखनऊ के उपभोक्ता फोरम ने कहा है कि व्हाट्सएप सेवा उपभोक्ता संरक्षण अधिनियम के अंदर नहीं आता है क्योंकि व्हाट्सएप का इस्तेमाल करने वाला व्यक्ति उपभोक्ता नहीं कहा माना जा सकता.

आजाद अधिकार सेना के राष्ट्रीय अध्यक्ष अमिताभ ठाकुर ने लखनऊ उपभोक्ता फोरम के सामने शिकायत की थी कि व्हाट्सएप कंपनी ने अनुचित ढंग से 24 घंटे तक उनके फोन पर व्हाट्सएप सेवाएं बाधित की, जिस प्रक्रिया में उनके करीब 24 मेगाबाइट डाटा का नुकसान हुआ. उन्होंने इस संबंध में क्षतिपूर्ति दिलवाए जाने की मांग की थी.

फोरम ने अपने आदेश में कहा कि किसी भी प्रकरण के उपभोक्ता फोरम द्वारा सुने जाने के लिए आवश्यक है कि संबंधित व्यक्ति उपभोक्ता संरक्षण अधिनियम के धारा 2(7) में उपभोक्ता माना जाए. कोई व्यक्ति धारा 2(7) में तभी उपभोक्ता माना जा सकता है, जब उसने इसके लिए कोई संदाय किया हो और उसने इस हेतु कोई प्रतिफल दिया हो.

फोरम ने कहा कि जब एक व्यक्ति व्हाट्सएप को प्ले स्टोर से डाउन करता है तो वह पूरी तरह स्वैच्छिक सेवा है और वह व्यक्ति इस सेवा का उपयोग करने के लिए किसी भी प्रकार की धनराशि व्हाट्सएप को नहीं देता है.

फोरम ने कहा कि अगर व्हाट्सएप से सेवा के दौरान किसी प्रकार के डाटा की क्षति हुई है तो अमिताभ ठाकुर इसके लिए दांडिक न्यायालय में जा सकते हैं, किंतु वह उपभोक्ता संरक्षण अधिनियम में किसी भी प्रकार से उपभोक्ता नहीं माने जा सकते.

अतः फोरम ने वाद को प्राथमिक स्तर पर खारिज कर दिया.

संलग्न कंज्यूमर फोरम का आदेश

A Lucknow consumer Forum has stated that WhatsApp service does not come under the Consumer protection act, as a person using WhatsApp cannot be called a consumer.

Azad Adhikar Sena President Amitabh Thakur had presented a petition before the Lucknow consumer court saying that WhatsApp had improperly disrupted its services for 24 hours and had caused deletion of around 24 megabyte of its data. He sought compensation in this regard.

The Forum said that for any matter to be heard by consumer Forum, it is necessary that the concerned person is a consumer. Under section 2(7) of the Consumer protection act, a person can be a consumer only when there is a consideration and monetary payment.

When a person downloads WhatsApp from Play Store, then it is a completely voluntary service and the person downloading the service does not pay anything for this services.

It said if there has been any data loss, then Amitabh Thakur can go can go to the criminal court under the Information technology act but he cannot be called a consumer under the Consumer protection act.
